Lands & Membership

The MCFN Lands & Membership (L&M) department offers the following services:

Lands

The Lands & Membership department has administered the lands services since January 2000 under the Reserve Lands Environmental Management Program (RLEMP). The department also assists with survey requirements, band land allotments, land transfers, MCFN land leases and maintenance of personal land files and MCFN owned lands.

Certificates of Possession

Certificates of Possession (CP) are issued by Indigenous Services Canada to individuals who hold property on reserve whether by themselves, as joint tenants or tenants in common. If you have misplaced your CP please call the L&M department for a new copy.

Joint Tenant(s): when two (2) or more MCFN members jointly hold equal undivided shares in the whole of a lot. Owning a lot in this manner DOES NOT form part of your estate. This means that upon the death of one joint owner the other joint owner’s interest will be passed to the surviving joint tenant(s) by right of survivorship.

Tenants in Common: when two (2) or more MCFN members hold equal or unequal undivided shares in the whole of a lot. Owning a lot in this manner DOES form part of your estate. Meaning upon the death of one tenant in common their interest in the lot will pass on to their estate or heirs.

Buying or Selling Land on MCFN

Selling Land on MCFN
If you own land and will be selling a portion of your lot you will need to have a survey done (see Land Survey Contact List) If you own land and will be selling your whole lot, you can call the L&M department to request a land transfer be prepared. Please provide the full name of the individual that you are selling your lot to.

Buying Land on MCFN
Buyer beware: Before buying land from another MCFN member please call the L&M office to verify you are dealing with the proper land owner. All financial transactions are between the buyer and the seller ONLY. The L&M department is not part of any financial transaction.

Surveys

All surveys need to be completed by a registered Canada Lands Surveyor. Prices are set by individual survey companies, and you are responsible for all costs associated with a survey.

You would need to request a survey if you own a piece of property and you are selling or transferring a portion to another MCFN member. Only the registered owner of the lot may request a survey on their lot. The registered owner/s of the lot will have to approve the preliminary survey prior to the survey being registered by Natural Resources Canada (NRCan). Once the survey is registered with NRCan it will then have a Canada Lands Survey Record (CLSR).

If you are unsure of your property lines you would also need to contact a registered Canada Land Surveyor to locate the property markers on your lot. There will be a cost associated with this. Please note some lots on MCFN will not have any property markers. These lots were made using a Regional Survey of Ontario (RSO). These types of surveys did not place survey markers on the property.

NRCan has advised L&M that any lot currently on an RSO should be resurveyed to a CLSR. If you own property on MCFN and would like to know if your lot is on a RSO or CLSR please call the office. If you choose to have your lot resurveyed, you will be responsible for all costs.
